Terms of Service

1. Agreement to terms

By accessing or using TwynIt ("the Service", "Platform"), operated by TwynIt ("we", "us", "our"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these terms.

2. Description of service

TwynIt is an AI-powered hiring platform for recruitment teams. It provides resume parsing, candidate scoring, pipeline management, AI-driven chat, and integrations with applicant tracking systems. The Platform is intended solely for internal hiring use by business customers — not for consumer use or by job seekers directly.

3. Accounts and access

You must create an account to use TwynIt. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Ensuring that all users in your organization comply with these terms
  • Promptly notifying us of any unauthorized access to your account

4. Acceptable use

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of applicable employment or data protection laws
  • Upload candidate data for which you do not have the legal right to process
  • Attempt to reverse-engineer, decompile, or extract the Platform's underlying AI models or algorithms
  • Use automated scripts or bots to access the Platform except via our documented API
  • Share access credentials with parties outside your organization
  • Use AI-generated scores as the sole basis for employment decisions in jurisdictions where this is prohibited

5. Candidate data and your responsibilities

You remain the data controller for all candidate personal data you upload to TwynIt. You are solely responsible for:

  • Obtaining necessary consents from candidates before uploading their data
  • Complying with applicable data protection laws (GDPR, DPDPA, CCPA, or other local regulations)
  • Informing candidates that their data may be processed by AI systems
  • Ensuring that AI-generated scores are used as a decision-support tool, not a replacement for human judgment

TwynIt acts as a data processor for candidate personal data. We process it solely on your instructions and in accordance with our Privacy Policy and any applicable Data Processing Agreement.

6. Subscription and billing

TwynIt offers a free plan (first job role included, no time limit) and a paid plan for additional job roles. By subscribing to a paid plan:

  • You authorize us to charge the applicable fee per job role created beyond the free tier
  • All fees are non-refundable except as required by applicable law
  • Prices are subject to change with 30 days' advance notice to active customers
  • Billing is processed via Stripe (USD/GBP) or Razorpay (INR)

7. Intellectual property

TwynIt and its underlying technology, AI models, algorithms, and design are owned by us and protected by intellectual property laws. You retain ownership of all content and data you upload to the Platform. You grant us a limited license to process your data solely to provide the Service.

8. AI-generated content disclaimer

AI-generated candidate scores, recommendations, interview questions, and email drafts are provided as decision-support tools. They may contain errors or omissions. All final hiring decisions are your responsibility. We do not warrant that AI outputs are free from bias or suitable for any particular hiring decision. You are solely responsible for compliance with anti-discrimination laws in your jurisdiction.

9. Limitation of liability

To the maximum extent permitted by law, TwynIt is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Platform, including but not limited to hiring decisions made based on AI-generated outputs. Our total cumulative liability to you shall not exceed the fees paid by you to us in the 12 months preceding the claim.

10. Service availability

We aim to maintain high availability but do not guarantee uninterrupted access to the Platform. We may perform maintenance, updates, or modifications that temporarily affect availability. We will endeavor to provide advance notice for planned downtime.

11. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your access immediately if you materially breach these terms or if required by law. Upon termination, your data will be retained for 90 days before deletion to allow for export, after which it will be permanently removed.

12. Governing law

These terms are governed by the laws of India. Any disputes shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996, before a sole arbitrator in Bangalore, India. For customers in the European Union, applicable EU law prevails to the extent required.

13. Changes to terms

We may update these Terms of Service. Material changes will be communicated via email to account holders at least 14 days before taking effect. Continued use of the Platform after that date constitutes acceptance of the updated terms.
